You’ve viewed and applied for a property for rent, and your application has been accepted, what next? You would receive your tenancy documents, and upon signing and returning them you can expect to pay anything up to 2 weeks rent in advance and 4 weeks rent as bond. These are the maximum amounts a landlord or agent can ask you to pay up front. This should be paid prior to the start date of your tenancy, and it can be stipulated as part of your tenancy offer that these costs are paid in full within a specified timeframe of receiving and signing your tenancy documents. Always talk to your potential agent or landlord when preparing to sign for a new tenancy so you understand what is required of you.
Landlords can charge up to 4 weeks rent as bond prior to the start of a tenancy. Upon receipt of this payment, a landlord or agent has 23 working days to lodge this with Tenancy Services. A tenant can request receipt of payment or contact Tenancy Services directly to enquire about the details of its lodgement. The bond is kept and secured with Tenancy Services for the duration of the tenancy. Tenants who have looked after the property, paid rent in full, and paid any amounts owing should get a refund of their bond when the tenancy ends. Whether your tenancy is about to start or end, talk with your agent or landlord to discuss the process of your bond payment and lodgement.
The healthy homes standards, which became law on 1 July 2019, introduced minimum standards for heating, insulation, ventilation, moisture ingress and drainage, and draught stopping in rental properties. They will help you to keep your home warm, dry and healthy. Landlords are responsible for ensuring their properties meet the healthy homes standards and continue to do so over time. A landlord or agent should disclose the current level of compliance for all new tenancies signed on or after 01 July 2021 by providing a current level of compliance healthy homes disclosure statement or certificate. If your property is not already fully compliant, a landlord has 120 days or until 01 July 2025, whichever comes first, to complete any required works to make their property fully compliant.
Landlords and tenants are both responsible for keeping the property in good condition. Whether you discover an appliance is not working, something is broken, or you have incurred damages to the property, you must notify your landlord or agent immediately. Not only is it important that these issues can be identified and fixed in a timely manner, but it could also pose a health and safety risk for you and your household if not reported and left unattended. Our advice is to always report it, no matter how big or small. Take a photo of the issue, write a concise description of the issue, and send it by email and text to your landlord or agent. If it is urgent, call your landlord or agent immediately, and then follow up with an email or text as previously advised. Any minor maintenance or defects that you forget to report, you will have a further opportunity to raise these issues at your 3-monthly routine inspection.
If you want to end your tenancy, it’s important to understand the rules for giving notice. The Residential Tenancies Amendment Act took effect on 11 February 2021 and changed the law on notice periods and reasons for ending a tenancy. Tenancy agreements signed before 11 February 2021: requirements for notice periods changed on 11 February 2021. If your tenancy agreement was signed before then, it may state an out-of-date notice period timeframe. Please follow the requirements in the Residential Tenancies Act 1986. For example, if your tenancy agreement was signed in January 2021 and says tenants must give 21 days’ notice to end the periodic tenancy, this is now 28 days’ notice. If you are on a periodic tenancy, you are required to issue a minimum of 28 days’ notice in writing to vacate. If you are on a fixed term tenancy, you are unable to issue notice to vacate if the notice period does not fall on or after the end date of the fixed term tenancy. You can however under special circumstances request to break your fixed term early, but this must be approved by your landlord, and there are strict conditions that apply – talk to your landlord or agent to learn more.
